Management of Personal Information and Credit Information
  1. Introduction AMHA Finance Pty Limited (ACN 154 693 455) trading as Liquid Capital (Liquid Capital) is committed to respecting and protecting the privacy of individuals who deal with us. We comply with the Australian Privacy Principles (APPs), and the Credit Reporting Regime as contained in the Privacy Act 1988 (Cth), and the Privacy Credit Reporting Code (CR Code). The APPs detail how personal information may be collected, used, disclosed, stored and destroyed, and how an individual may gain access to or make complaints about the personal information held about them.  The Credit Reporting Regime and the CR Code specifically detail how we must treat credit information and credit eligibility information in your personal credit file.This privacy policy deals with how we manage the personal, sensitive and credit information collected by us. We are committed to protecting the personal, sensitive and credit information that we hold about you.

Personal, Sensitive and Credit information we collect and hold “Personal information” is information or an opinion about an identified individual, or about an individual who is reasonably identifiable.“Sensitive Information”, a sub-set of personal information, is information or an opinion about an individual’s racial or ethnic origin, political opinions, political association membership, religious beliefs or affiliations, philosophical beliefs, professional or trade association membership, trade union membership, sexual orientation or practices or criminal record, and includes health information and genetic information.“Credit Information” includes information that identifies an individual, or that relates to the amount borrowed by an individual, any repayments or defaults.In dealing with you, we may collect both business information and personal information. The collection of personal information is necessary or unavoidable (eg, when we provide credit assistance to you personally, or to the entities with which you are affiliated).The kinds of information we collect from you or about you depend on the transaction you have entered into with us, the services you or your organization have contracted us to provide, and the services you or your organization are interested in.If you are a current or prospective customer of our credit assistance services, or a guarantor for a proposed finance arrangement, then the kinds of information that we commonly collect and hold from you or about you will include:
    • your name, alias or previous names, current and previous address/es, gender, phone, fax and mobile numbers, email address and date of birth;
    • personal, sensitive and credit information relevant to your verifying your identity, including your Government-issued identification documents (eg, passport, birth certificate, drivers licence details, etc);
    • personal, sensitive and credit information relevant to your finance enquiry or application, including your marital status, family composition, occupation, tax file number, bank details, employment status and history, credit information, credit history and credit worthiness, and credit eligibility information. This may include your personal current credit liabilities, previous credit payments and defaults, current and previous Court proceedings and insolvency actions against you and information about your credit worthiness.  This credit information may relate to both consumer and/or commercial credit;
    • reports and information disclosed to us by a credit reporting body (such as Equifax, illion or Experian), and/or the selected financier/s for your chosen finance product; and
    • details of the products or goods you are seeking to finance or guarantee (eg, current and previous vehicle details, vehicle registration details etc).
    We may also collect other personal, sensitive and credit information, depending on the nature of your transactions with us. Liquid Capital may during the course of your use of the Liquid Capital website electronically collect, store and use your personal information including your gender, country of residence, non-personal browsing habits and click patterns, e-mail address, IP address and ID number. This will be for internal use only.
  3. How we collect and hold information We will collect information directly from you, unless it is unreasonable or impracticable for us to do so. For example, we collect information from you or about you from correspondence that you submit to us, meetings and interviews with us, telephone calls with us, the financing instructions you provide to us, the completed application forms, identification check forms and other contractual documentation you submit to us, and from your activity on our website. 

    However, in many instances we will receive information about you from third parties, including:

    • Credit reporting bodies;
    • The brokers, aggregators, finance providers and insurance companies involved in your finance enquiry or application;
    • Your credit referees;
    • Your family members and authorized third parties (such as your accountant, financial planner and other advisory consultants);
    • Publicly available sources;
    • Government agencies;
    • Affiliated businesses and other entities in our Motus Australia corporate group, including the motor vehicle dealership at which your motor vehicle purchase or finance enquiry may have arisen;
    • Auction houses; and
    • The online vehicle enquiry, sale and service platforms which you browse or engage with, such as CarSales and similar platforms.
    • the use of your true identity is a legal requirement; or
    • it is impracticable for us to deal with you on such basis.

    You can be anonymous or use a pseudonym when dealing with us, unless:

    • the use of your true identity is a legal requirement; or
    • it is impracticable for us to deal with you on such basis.
    The security, accuracy and integrity of the data on the Liquid Capital website (Website Data) is of material importance to Liquid Capital. Liquid Capital accordingly reserves the right to conduct whatever verification of your identity and details it deems appropriate prior to Registration Confirmation, and to use whatever technological and other measures it deems necessary to detect and prevent unauthorized access or attempts to gain unauthorized access to the Website Data or to restricted pages of the Liquid Capital website. You hereby agree to allow Liquid Capital to take all reasonable steps to ensure the integrity and security of the Website Data and related back-office applications and agree to comply at your cost with all reasonable security measures which Liquid Capital may notify you with from time to time regarding access to the Website Data. Any person who delivers or attempts to deliver any damaging code to the Liquid Capital website or attempts to gain unauthorized access to any page on this site or to any Website Data shall be prosecuted and civil damages shall be claimed in the event that Liquid Capital or any of its customers suffers any damage or loss. You hereby agree that you have the choice as to whether to provide any personal information on this website, noting however, that withholding certain details may limit the ability of Liquid Capital to offer its services to you.
  4. How we use and disclose information We use and disclose personal, sensitive and credit information from you or about you where it is reasonably necessary for us to carry out our business functions, activities and services.For example, we use and disclose your information:
    • To enable us, affiliated companies or other entities in the Motus Australia corporate group, to properly respond to your interest in or request about motor vehicle or other goods purchases, finance or insurance.
    • To provide you with information about our products or offers, marketing and promotions, and newsletter communications.
    • To provide you with information about the motor vehicle dealership businesses within the Motus Australia corporate group and their service offerings.
    • To enable us to arrange for you things like vehicle finance or insurance.
    • To maintain records for accounting, administrative, trade reference, fraud check and legal requirements.
    • To conduct customer satisfaction, feedback and quality assurance surveys.
    • To collate statistical data, and to conduct market research, social media analysis and website traffic analysis.
    Where we use your personal information for marketing and promotional purposes, you can opt out at any time by notifying us. Opt out procedures are also included in our marketing communications. We may disclose your personal information to:
    • affiliated third party service providers to you or our business;
    • the other entities in the Motus Australia corporate group;
    • the motor vehicle dealerships in the Motus Australia corporate group; and
    • government departments and enforcement bodies where required or permitted by law.
    Where we wish to use or disclose your personal information for other purposes, we will obtain your consent. If we do not use or disclose your personal, sensitive or credit information, or if you do not consent, then we may not be able to answer your enquiry, complete the transaction you have entered into, or provide the services that you or your organization have contracted us to provide.
  5. How you may access your information We have procedures in place for dealing with and responding to requests for access to, and correction of, the personal, sensitive and credit information held about you.  In most cases, we expect that we will be able to comply with your request.  However, if we do not agree to provide you access or to correct the information as requested, we will give you written reasons why.You may access your personal, sensitive and credit information, and obtain further detail on our processes, by contacting us via email at david@liquidcapitalfs.com.auYou have the right to ask for a copy of any credit reports Liquid Capital has obtained from a credit reporting agency or your selected financier/s. Copies of credit reports may also be obtained directly from the credit reporting body or your selected financier/s. You have the right to have any inaccuracies corrected, or if there is any dispute about the accuracy of the information, a file note can be added to your file explaining the position.We will take reasonable steps to ensure that the personal, sensitive and credit information we use or disclose is accurate, complete and up to date, having regard to the purpose of the use or disclosure. We rely on the information we hold about you to efficiently provide our services. For this reason, it is very important that the information we collect from you is accurate, complete and up-to-date. To assist us to keep our records up-to-date, please notify us on david@liquidcapitalfs.com.au of any changes to your personal, sensitive and credit information.
  6. Destruction and De-identification We protect your personal, sensitive and credit information in a number of ways, and take reasonable steps to ensure that it is protected from misuse, interference and loss, and from unauthorized access, modification and disclosure, in accordance with our obligations under the Privacy Act, the APPs and the CR Code.Your information is kept in secure locations, and access to it is restricted to those who have the appropriate authorization under our policies. Where we share the information with third parties, we ensure they also have appropriate policies and security in place.We will retain your personal, sensitive and credit information whilst it is required for any of our business functions or purposes as outlined in this Policy, or other lawful purpose in accordance with the Privacy Act.When the information is no longer required, it is de-identified, deleted, or securely destroyed. As an example, our destruction and de-identification methods may include:
    • Paper records being placed in security bins and/or shredded; or
    • Electronic records being deleted from all locations, to the best of our ability, or encrypted and/or placed beyond use.

Data Breaches In Australia, if we suspect that a data breach has occurred, we will undertake an assessment into the circumstances of the suspected breach within 30 days after the suspected breach has occurred.Where it is ascertained that a breach has actually occurred and where required by law, we will notify the Privacy Commissioner and affected individuals as soon as practicable after becoming aware that a data breach has occurred.

How you may make a privacy complaint Our Privacy Officer can be contacted to discuss or attempt to resolve any complaints relating to the collection, storage and use of your personal, sensitive and credit information.  For further information, please contact our Privacy Officer at david@liquidcapitalfs.com.auWe have procedures in place for dealing complaints and concerns about our practices in relation to the Privacy Act, the APPs, the CR Code and any alleged breach of this Policy.We will respond to your complaint in accordance with the relevant provisions of the Privacy Act.  If you are dissatisfied with the outcome of the complaint or the investigation, you may refer your complaint to the Office of the Australian Information Commissioner.
  9. Transfer of information overseas Our business is affiliated with other businesses located overseas, such as United Kingdom and South Africa. In the course of doing business with you, we are likely to disclose some of your personal information to overseas recipients. However, we will only do so where:
    • it is necessary to complete the transaction you have entered into; and
    • you have provided consent; or
    • we believe on reasonable grounds that the overseas recipient is required to deal with your personal information by enforceable laws which are similar to the requirements under the APPs; or
    • it is otherwise permitted by law.
    While it is not practicable to list every country in which such recipients may be located, recipients of such disclosures are likely to include countries where our parent companies are located in United Kingdom and South Africa.

    Google Analytics, Display Advertising and Remarketing

    The Google Analytics features implemented on the Liquid Capital website is based on Display Advertising (e.g., Remarketing, Google Display Network Impression Reporting, the DoubleClick Campaign Manager integration, or Google Analytics Demographics and Interest Reporting).

    Visitors can opt-out of Google Analytics for Display Advertising and customize Google Display Network ads using the Ads Settings.

    Liquid Capital will not facilitate the merging of personally-identifiable information with non-personally identifiable information previously collected from Display Advertising features that is based on the DoubleClick cookie unless robust notice of, and the user’s prior affirmative (i.e. opt-in) consent to, that merger is given.

    Liquid Capital also uses Remarketing with Google Analytics to advertise online. This means that third-party vendors, including Google, show your ads on sites across the Internet.

    Cookies are used to identify an IP address and remarket relevant advertising material to interested parties.
